Pending Terms of Service

1. Agreement to Terms

Pending is operated by Sarel Kaminsky ("Pending," "we," "our," or "us"). By accessing or using Pending, you agree to these Terms of Service. If you do not agree, do not use the service.

2. What Pending Provides

Pending provides tools for tracking purchases, shipments, and delivery-related information. Features may change over time as we improve the product.

3. Accounts and Eligibility

• You are responsible for maintaining the security of your account and credentials.
• You are responsible for activity that occurs under your account.
• You must provide accurate information and keep it up to date.

4. Beta Access and Future Pricing

• Pending is currently available to invited beta members without a subscription fee.
• Beta access may include feature, usage, or capacity limits and may change as the service develops.
• Free beta access does not guarantee that Pending will remain free after the beta.
• We will disclose future pricing before charging you. Beta access will not automatically become a paid subscription.

5. Refunds

Pending does not currently charge invited beta members. If paid plans are introduced, eligible payments will be handled according to the refund policy presented with those plans and our Refund Policy. Questions can be sent to hello@pending.to.

6. Acceptable Use

You agree not to misuse Pending, including by:

• attempting to gain unauthorized access to systems or data;
• interfering with service integrity, security, or performance;
• using the service for unlawful, fraudulent, or abusive conduct.

7. Third-Party Services

Pending may integrate with third-party providers (such as email providers and payment processors). Your use of third-party services is also subject to their terms and policies.

8. Privacy

Our collection and use of personal information is described in our Privacy Policy.

9. Service Availability and Changes

We may modify, suspend, or discontinue parts of the service at any time. While we aim for reliable availability, uptime is not guaranteed.

10. Disclaimer of Warranties

Pending is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Pending and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business interruption arising from or related to your use of the service.

12. Termination

You may stop using Pending at any time. We may suspend or terminate access if you violate these Terms, pose a security risk, or misuse the service.

13. Changes to These Terms

We may update these Terms from time to time. Updated versions will be posted on this page with a revised effective date. Continued use of Pending after changes means you accept the updated Terms.

14. Governing Law

These Terms are governed by applicable law in the jurisdiction where Pending is based, unless mandatory consumer protection laws in your location require otherwise.
