Pending Terms of Service

1. Agreement to Terms
Pending is operated by Sarel Kaminsky ("Pending," "we," "our," or "us"). By accessing or using Pending, you agree to these Terms of Service. If you do not agree, do not use the service.
2. What Pending Provides
Pending provides tools for tracking purchases, shipments, and delivery-related information. Features may change over time as we improve the product.
3. Accounts and Eligibility
You are responsible for maintaining the security of your account and credentials.
You are responsible for activity that occurs under your account.
You must provide accurate information and keep it up to date.
Children and Minors
The Service is intended only for individuals who are 18 years of age or older. If you are under the age of 18, you may not register for or use the Service. If you are currently using the Service and are under 18, you must discontinue use immediately. By registering for or using the Service, you confirm that you are at least 18 years old. We may suspend or terminate any account if we reasonably believe that the user is under the age of 18.
4. Paid Plans and Scan Credits
Paid checkout is available only when enabled. Displaying a plan or selecting it does not activate access or take payment. The price, taxes and final total are shown before purchase. Prices are in USD.
Occasional checks: $18.99 once for 3 scans. Purchased pack credits do not expire while your account and Pending remain available.
Regular checks: $12.99 per month for 6 scans per paid billing period. This subscription renews automatically until canceled. Unused monthly scans expire at the end of their billing period and do not roll over.
The previously advertised founding-member offer is no longer available for new purchases. If you purchased that offer before it was withdrawn, the terms applicable to that purchase continue to govern your existing entitlement, subject to applicable law.
Promotional and invitation-only offers
Pending may offer discounts, promotional prices, or private or invitation-only offers from time to time. Any offer-specific eligibility requirements, price, scan allowance, duration, invitation limits and other conditions, including any price lock, will be disclosed separately to eligible customers before acceptance or purchase. Those offer-specific terms govern the relevant offer, including any price lock, and are not overridden by a general update to these Terms.
A scan is one completed check of the Gmail account you connected, using the date range selected in the interface: the last 30, 90 or 120 days, or a selected calendar month. The first connection checks the last 120 days. Results depend on available messages and supported parsing; a scan is not a guarantee of finding every order or a lost delivery.
Each completed scan uses one credit, including a scan with no findings. A technical failure returns its reserved credit; recovery may be delayed if a request or connection is interrupted. Reading saved results does not use credits. These plans do not include automatic Gmail monitoring or alerts. Reprocessing an existing order corrects saved evidence and does not add a new scan charge.
Each new account receives one free scan. New scans require an available scan credit, whether free or paid. Using the free scan does not automatically start a paid subscription or authorize a charge. Connecting Gmail does not authorize a payment. Monthly cancellation is available through Settings → Your plan & scans. Cancel before the next renewal to stop the next charge; already paid monthly scans remain usable until the current period ends.
Paddle acts as reseller and merchant of record for purchases through Paddle checkout. Its Buyer Terms apply to those transactions. Pending supplies the product. Purchased credits are granted only after payment is confirmed on the server.
5. Refunds and Billing Issues
Refund requests are handled under applicable consumer rights and Paddle's refund rules. Pending does not offer an additional blanket money-back guarantee. See our Refund Policy for the request process and how approved refunds affect access. Cancellation stops future renewals; it does not itself refund a completed payment. Findings do not confirm that a parcel is lost or guarantee a merchant or carrier refund.
6. Acceptable Use
You agree not to misuse Pending, including by:
attempting to gain unauthorized access to systems or data;
interfering with service integrity, security, or performance;
using the service for unlawful, fraudulent, or abusive conduct.
7. Third-Party Services
Pending may integrate with third-party providers (such as email providers and payment processors). Your use of third-party services is also subject to their terms and policies.
8. Privacy
Our collection and use of personal information is described in our Privacy Policy.
9. Service Availability and Changes
We may modify, suspend, or discontinue parts of the service at any time. While we aim for reliable availability, uptime is not guaranteed.
10. Disclaimer of Warranties
Pending is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, Pending and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business interruption arising from or related to your use of the service.
12. Termination
You may stop using Pending at any time. Account deletion cancels outstanding subscriptions before deletion can complete, removes unused credits and does not itself issue a refund. If payment reconciliation prevents deletion, contact hello@pending.to for assistance. We may suspend or terminate access if you violate these Terms, pose a security risk, or misuse the service.
13. Changes to These Terms
We may update these Terms from time to time. Updated versions will be posted on this page with a revised effective date. Where applicable law requires additional notice or affirmative consent, we will provide that notice or obtain that consent. Otherwise, continued use of Pending after the revised Terms take effect constitutes acceptance to the extent permitted by law.
14. Governing Law
These Terms are governed by the laws of the State of Israel, without prejudice to any mandatory consumer protection rights or other mandatory rights that apply to you under the laws of your place of residence.
